The terms of use for this site are broken down by category: rules, privacy, agreements, severability, and miscellaneous legal crap.
The basic rules for using this site are simple and straightforward:
Don't steal other people's scripts or use them without permission from its creator.
Don't steal site-provided content or use it elsewhere without permission. You may use the site logo in reviews of this site, so long as you make the site logo be a link back to this site if it is technically feasible to do so.
Don't use this site to do anything that is illegal in California or in your local jurisdiction.
Don't use this site to do anything that could get us in trouble with the law or with our ISP.
Act appropriately in the forums. In other words:
Posts that do not follow these rules may be deleted, and may cause your posting privileges to be suspended.
Don't try to disrupt this service.
Don't run screen scrapers or other indexing tools.
Don't use custom JavaScript code or other tools to try to break the site.
If you find a bug, report it. See the FAQ for details.
We may add other rules over time. If you violate these rules, we reserve the right to disable your account or to report your activities to the appropriate authorities.
This privacy policy is in four parts: personal information, forum content, user-created content, and the kitchen sink.
By using this site, you agree to provide certain personal information. We don't collect any personal information beyond what you give us, which minimally means a username, a password, and a valid email address. That's all we require.
Well, that and the IP address you connected from, which may or may not be logged, depending on the phase of the moon, the color of the shirt I'm wearing, or even how much hair gel that weird guy down the street from me put into his hair this morning. You know the one. In other words, we reserve the right to log it or not log it at our sole discretion, and we won't be held liable either way.
We don't share your personal information with anyone except as follows:
Apart from the above, we will not intentionally disclose your personal information except as required by law (whether by subpoena or otherwise) or as required to provide any outside service that you might request. (Currently, no such outside services exist; we're just covering our bases so that we don't have to update this privacy policy in the future if we team up with somebody to provide something cool. Any such cool features will be entirely opt-in.)
However, by using this site, you agree to not hold us liable if your personal information is inadvertently disclosed, even if we were previously made aware of the possibility of such disclosure.
Simply put, if you consider your privacy important enough to be angry about an accidental disclosure, then it is your responsibility to withhold your personal information from us, and to create a disposable email address for use in your your interactions with this website. We've made what we consider to be a reasonable effort to minimize that risk, but we're not your mommy and daddy; the remaining responsibility lies with you.
In an ideal world, this would go without saying, but in our litigious society, we felt that we should at least mention the forums here.
Forum content is public. You have no privacy rights in a public forum. Don't post anything that you don't want the entire freaking world to see.
You agree not to sue us, attempt any sort of arbitration proceedings, or even so much as whine and complain to us about anything posted in the forums by you or anyone else (except to complain to us about other users violating the terms of service, and we reserve the right to act upon or ignore any such complaints at our sole discretion).
Finally, our ISP may have access to our database. To the extent that this is the case, their privacy policy applies. Not that it matters, of course, given that the content in question isn't private.
We don't share your user-created content with anyone unless you choose to publish it for review. If you do, we do, and you grant us the right to do so.
However, by using this site, you agree to not hold us liable if your user-created content is inadvertently disclosed, even if we were previously made aware of the possibility of such disclosure.
As a general rule, what you write is your business, and will not be shared with others. As an exception, we (or employees of our ISP) may need to dig through the site's database, logs, and so on while fixing problems. When we do, we reserve the right to act upon anything that we discover. This right includes, but is not limited to any user-authored content (including private messages) that violates the law, violates our terms of use, or leads us to suspect that you or someone else might harm yourself or others.
However, we do not accept any responsibility for failing to act upon such content, even if it has been brought to our attention.
Finally, our ISP may have access to our database. To the extent that this is the case, their privacy policy applies.
This site uses cookies for the discussion forum because PHPBB is lame and uses server-side content rendering. These cookies are used only for the discussion forums. If you do not want to use the discussion forums, you can block cookies for this site, and the remainder of this site should continue to function correctly, but please don't do that, as it clogs up the PHPBB database with junk cookie records. Like we said, PHPBB is lame.
Other than that, this site does not currently use cookies. If, at any point in the future, this site becomes ad-supported (which we hope to avoid), that might change. However, even if that happens, we have no intention of providing your personal information to advertisers.
We reserve the right to update this privacy policy if necessary, and we will post appropriate notifications on this site well in advance of any significant changes, should such changes be necessary. We will not post notifications about fixes for typographical errors, minor clarification of existing policies, or other changes if we feel that they do not represent material changes to the policy.
During the beta testing period, because we are still actively constructing this privacy policy, this policy may be changed without notice, including material changes to the policy, so if you care about the details, check back regularly.
By using this site, you agree:
You also affirm that you understand this agreement in its entirety, including the rules and privacy policy above.
You further acknowledge your understanding that these rules can be updated at any time, for any reason. Except for privacy policy changes, we will not necessarily notify anyone about changes to the terms of use unless they are expected to be contentious or materially alter your legal rights.
You may terminate your account at any time by contacting an administrator though the forum's private message system. You agree that:
After terminating your account, these terms of use are no longer binding upon you except for this section (Termination) and the next section (Miscellaneous Legal Crap).
If any part of these terms of service should be ruled unenforceable, the remaining terms shall be enforceable to the maximum extent possible. In particular, should any changes to the terms of service be ruled unenforceable because of insufficient notification, the version of the rules that you agreed to when you created your account remains in full force to the maximum extent possible.
Your right to use this site is predicated upon the acceptance of and legal force of these terms of service. If this site's entire terms of service are held to be unenforceable, then you have no right to use this service.
This agreement shall be governed by and construed and enforced in accordance with the laws of the State of California, Santa Clara County, without regard to its conflict of laws rules. All legal action not settled through arbitration shall be settled in a venue within that county or, should no such venue of suitable jurisdiction exist, in the nearest venue of suitable jurisdiction.
